THE FIRST CITY ON MARS?
A settlement is not only a structure. It is a claim about who decides.
Who writes the rules of a place built by one organisation, funded by another, and lived in by people who arrived later?
Mars managed four billion years without an owner. The question is what changes the moment someone stays.
The 1967 Outer Space Treaty states that outer space, including the Moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty.
It says considerably less about private operations, resource extraction and the internal governance of long-term habitats.
So the legal question is genuinely open — not because the law is silent, but because it was written before the situation existed.
OWNED BY THOSE WHO BUILD
The people and organisations who accept the cost and the risk carry the responsibility, and responsibility without authority does not survive an emergency.
A habitat is a machine where a bad decision kills everyone inside. Someone has to be able to decide.

Air, water and power in a Martian habitat are produced by shared systems. Whoever controls life support holds a form of authority no vote removes.
With a one-way delay of minutes, no authority on Earth can supervise a Martian decision as it happens. Governance would have to be local by physics alone.
