Space × Law
Treaties, liability, governance, resources and public responsibility.
A. The Question
How can law govern activity beyond Earth when states remain responsible for national activities but operations increasingly involve private and multinational actors?
B. What We Know
The Outer Space Treaty establishes core principles including peaceful use, non-appropriation and state responsibility. Related agreements address rescue, liability and registration. Application to new activities can remain disputed.
C. Perspectives
Some interpretations see existing principles as flexible enough for resource activity under national authorisation. Others argue that clearer international rules are needed to protect common interests and prevent de facto appropriation.
D. Case File
A future settlement would raise questions spanning jurisdiction, safety, labour, environmental protection and political representation. No existing treaty supplies a complete municipal governance model for such a community.
E. Open Questions
What distinguishes use from appropriation? How should liability work across complex supply chains? What voice should future residents have? Which environments merit special protection?
